No Fault Judicial Estoppel

The Eleventh Circuit in Robinson v. Tyson Foods, Inc., has added new dimensions to the old aphorism, "No good deed goes unpunished." Any bankruptcy practitioner of more than recent vintage has known the particular mix of mortification and dread brought on by clients who fail to disclose an interest in property until the most inopportune moment.
